Note for the site owner: this page is a starting draft written to be sensible and fair, not legal advice. Have it reviewed against how you actually operate — particularly the payment, liability and access clauses — and replace every bracketed placeholder before publishing.
1. About these terms
These terms apply to leak detection and inspection services provided by Aquila Water Leak Detection (ABN [insert ABN]) to you, the customer. By booking a service you accept them. If we've given you a separate written quote or agreement, that document takes precedence where the two conflict.
2. Quotes and pricing
- Quotes are based on the information you give us when booking. If conditions at the property differ materially, we'll tell you before continuing and confirm any change in price.
- Quotes are valid for [insert number] days unless stated otherwise.
- Prices include GST unless stated otherwise.
3. What our service covers
We provide leak detection — locating and reporting on the likely source of water escape using non-invasive equipment. Unless we've agreed otherwise in writing, our service does not include plumbing repairs, excavation, waterproofing, tiling or making good.
Detection equipment is highly effective but not infallible. Building construction, ground conditions, background noise and the nature of the leak can all limit what can be determined without invasive access. Where we can't reach a conclusive finding, we'll tell you plainly what we did establish and what would be needed to go further.
4. Access to the property
- You need to give us safe and reasonable access to the property and the relevant areas, including the water meter and any service points.
- You confirm you own the property or are authorised by the owner to arrange the work.
- Please tell us about known hazards — asbestos, unsafe flooring, aggressive animals, electrical faults — before we attend.
- The water supply should be connected and pressurised. Detection generally can't be carried out on an isolated system.
5. Bookings, cancellations and access failures
Bookings are taken Monday to Friday, 7:00am to 5:00pm. If you need to cancel or reschedule, please give us at least [insert number] hours' notice. Where we attend as arranged and can't gain access, a call-out fee of [insert amount] may apply.
6. Reports
Written reports record our findings and opinion at the date of inspection, based on conditions observed on the day. They are prepared for you and for the purpose you told us about (for example, an insurance claim or body corporate matter). We're happy for you to give a report to your insurer, plumber, agent or committee. Reports should not be relied on by anyone else, or used for a different purpose, without our written agreement.
We are not your insurer, assessor or legal adviser, and nothing in a report is advice about whether a claim will be accepted.
7. Payment
- Payment is due [insert terms — e.g. on completion / within 7 days of invoice].
- Accepted payment methods are set out on the invoice.
- Overdue accounts may attract reasonable recovery costs.
8. Your rights under Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law — including that they will be provided with due care and skill, and fit for the purpose we've been told about. Nothing in these terms limits those rights.
To the extent permitted by law, and apart from those guarantees, our liability for any claim connected with our services is limited to resupplying the service or paying the cost of having it resupplied.
9. Limits on liability
To the extent permitted by law, we are not liable for:
- Damage that existed before we attended, or that continues because a leak we located was not repaired
- Loss arising from information you gave us that was incomplete or inaccurate
- Repairs, excavation or making good carried out by others on the basis of our findings
- Indirect or consequential loss, including loss of rent, income or opportunity
10. Privacy
We handle your personal information in accordance with our Privacy Policy.
11. Website content
Content on this website is provided for general information. It isn't advice about your specific property, and it shouldn't be relied on as a substitute for an inspection. We try to keep it accurate and current but don't warrant that it is free of error.
12. Governing law
These terms are governed by the laws of [insert Queensland or New South Wales], and the courts of that jurisdiction have non-exclusive jurisdiction over any dispute.
